Costa Mesa Getting Ready to Shut Down Medical Marijuana Dispensaries

On April 12, 2011 the city of Costa Mesa held a study session regarding the regulation of medical marijuana dispensaries in their city. A professional presentation was put together and the city council members (and mayor) received compelling argument with supporting documentation on why they should tax and regulate the dispensaries. More and more dispensaries are having their merchant services and banks freeze their assets and cancel their accounts. The federal government, back in 2008, sent letters to the major banks telling them NOT to do business with the medical marijuana industry or risk losing FDIC insurance. As a result it has been a banking nightmare for collectives.

However there are few banks that will still willingly handle merchant accounts for this business.

This coming Tuesday (June 21, 2011) California lawmakers will make a final vote on SB 847 (submitted by Sen Lou Correa) which would restrict dispensaries/collectives and where marijuana can be grown to >600 feet from ANY residential property. This law would force the closure of many dispensaries. In addition any patients that collectively grow medicine on their properties would be forced to stop their grow. For example, patients who live in condos without yards and grow their medicine in friends properties (who also grow) would not be able to do so.
